Use of Quran As the Source of Legal thinking
- The Holy Quran is the main source of legal thinking & farming the laws.
- The Holy Quran is the Foundation head from which all other sources have been derived.
- The Holy Quran tells the Muslim to decide the matters in the light of its teachings & through mutual cosultation.
- On these principles the parliament (Majlis-e-Shoora) is considered to be an authority to frame the laws of the Islamic State.
- The Laws of inheritance are clearly defined in the Holy Quran & these are applicable to both the (CPC) Civil Procedure Code and the (CrPC) Criminal Procedure Code of the Country.
- Quran also tells about the punishments to deals with the Criminal laws under the teachers of Holy Quran.
- Finality of Prophet-hood is one of the basic articles of faith, its denial leads to the denial of the whole faith as the Holy Quran says; ''Muhammad (SAW) is not father of any male in you , he is the Messneger of Allah and is a seal of Prophet-hood.''
- Under the light of the verse, the 1973 Constitution of Pakistan declared Ahmadis ( those who don't believe in the finality of the Prophet-hood of Muhammad ((SAW)) as non-Muslims.
- The Family laws of the states (laws of Marriage, divorce, remarriage of women etc are derived in the lights of the Holy Quran.
- Quran puts great emphasis on the rights of Orphans & predicts severe punishment for the ones who illegally grab the property of orphans; examples of the Masjid-e-Nabvi.
- The Holy Quran says; ''Those who unjustly eat up the property of orphans, eat up a fire into their own bodies''(4:10)
- Islamic state has to implement the punishments given in the Holy Quran about the crimes like fornication, adultry, drinking & selling of alcohal, murder etc.
